Drunk drivers continue to menace the roadways

Although it's always an underlying consideration, most Arizona drivers seldom dwell on the possibility of becoming involved in a motor vehicle accident. Driving is such an everyday, common part of people's lives, it's natural to be complacent about highway safety. And, in fact, the statistics regarding accidents show our nation's roads are becoming safer in recent years as compared to previous times. In one sense, the word 'accident," as used to refer to a crash involving motor vehicles, is a misnomer. In such occurrences, it is almost always the case that at least one of the drivers of the vehicles has acted negligently in a manner that directly led to the 'accident." Every driver is charged with the duty of driving safely and properly under the conditions that exist, and a failure to do so that results in damage to another exposes the at-fault driver to liability. Legal experts explain that drinking and driving, at any level, diminishes the driver's ability to safely operate a motor vehicle.

Drinking has been proven so dangerous for drivers that every state has a per se law that makes it illegal to drive with a certain blood alcohol content. That currently is 0.08 in every state but Utah, which has become the first state to lower its per se limit to 0.05. It is expected other states will soon follow Utah's lead. The drunk driver's legal liability is one matter, but the real problem is the significant cost in physical injury and death other drivers and passengers face, along with the property damage that drunken driving causes year after year.
